Note: This
application form is to be used for the submission of items to the FAVOR
organization for consideration for sale in the Florida Keys National Wildlife
Refuges Visitor Center, Winn Dixie Shopping Plaza, Big Pine Key, FL.
Please refer to the attached chart to itemize and clearly
describe your items being submitted.
Please be sure your label or business card is securely attached to each
item.
Because your artwork will be displayed and sold at a
National Wildlife Refuge Visitor Center, please read the following Mission
Statement and Goals of the FAVOR:
With the above in mind, please submit, along with your
product, a short “educational” statement or slogan, such as a history of the
photos or paintings as they relate to the Keys environment, where the subject
is found, (Keys or other areas in Florida or the U.S.), and any information
which would delineate the nature of your artwork as an educational product.

commission new merchandise. To that
end, do not forget to fill out the Consignment Contract on the following page.
Be advised that sales records will be reviewed periodically,
and depending on sales we may opt to continue on consignment, purchase
outright, or discontinue your product(s).

FAVOR FLORIDA KEYS, INC.
CONSIGNMENT CONTRACT
1.
This contract is by and
between _______________________________ (CUSTOMER),
and
Friends And Volunteers Of Refuges, Inc (FAVOR), a Florida Corporation, and the
parties agree to the following consignment conditions.
2.
Property Consigned: (See attached “Application for Bookstore Sales” property
chart).
3.
Efforts to Sell:
FAVOR
will display the items and attempt to sell them at or above the prices listed
on the application property chart.
FAVOR will obtain the written consent of Customer before selling the
items at prices lower than those listed on the application property chart.
4.
Proceeds of Sale:
Following
a sale, FAVOR will retain from the sales proceeds a commission of twenty-five
percent (25%) of the sale price.
Commission will be computed on the pre-tax price. FAVOR will send the balance of the sale
proceeds to Customer on a monthly basis.
5.
Ownership Before
Sale:
Customer
will retain ownership of the items until they are sold.
6.
Risk of Loss:
While
the items are in FAVOR’s possession, Customer will bear the risk of damage to
or loss of the items.
7.
Termination of
Consignment:
Customer
or FAVOR may terminate this contract at any time. If either party terminates the agreement, Customer will pick up
all items at their earliest convenience.
8.
Notices:
All
notices must be in writing to the address of record. A notice may be delivered to a party at the address that follows
a party’s signature or to a new address that a party designates in
writing. A notice may be delivered
either to the address of record or delivered in person.
9.
Modification and
Waivers:
This
agreement may be modified in writing signed by both parties. If one party
waives any term or provision of this agreement at any time, that waiver will be
effective only for the specific instance and specific purpose for which the
waiver was given.
10.
Governing Law:
This
agreement will be governed by and construed in accordance with the laws of the
State of Florida.
11.
Severability:
If any court determines that any provision of this agreement is invalid or
unenforceable, any invalidity or unenforceability will affect only that
provision and will not make any other provision of this agreement invalid or
unenforceable and shall be modified, amended or limited only to the extent
necessary to render it valid and enforceable.
